General Terms and Conditions of Sale

These terms consist of two parts: Part A applies to repairs, Part B to purchases in our webshop. The seller and repairer is PHONETECH BV, trading as iFixers, Bondgenotenlaan 175, 3000 Leuven, Belgium, VAT BE0848759106, info@ifixers.be, 016 23 77 74.

Part A — Repairs

General Repair Terms for Consumer Electronics, applicable in cases where PHONETECH BV (hereinafter referred to as "the trader") acts as repairer of consumer electronics (hereinafter referred to as "the product"). Articles 2 to 6, 11 and 12 of the General Repair Terms for Consumer Electronics do not apply in (warranty) cases where the customer is entitled to a free repair.

General provisions — Complaints

1. Repairs are based on the complaints described on the drop-off receipt.

Price

2. The price of the repair is determined exclusively on the basis of the number of hours worked, the collection and return delivery costs, the inspection costs, the cost of materials used, shipping and administration costs and the costs incurred by third parties, all including VAT.

Drop-off receipt

3. The drop-off receipt always states the inspection costs and the expected duration of the repair. Where and to the extent possible, the drop-off receipt also states an estimate of the repair costs.

Stopping or proceeding

4. If, upon inspection, it turns out that the price of the repair needed to restore the product to its original condition will be higher than the cost estimate stated on the drop-off receipt, the customer will be asked whether they want the product repaired at that higher price. In that case the repair will only take place after the customer's consent. If the drop-off receipt does not state a cost estimate and the price can only be determined after inspection, the customer will be asked whether they want the product repaired at that price. In that case too, the repair will only take place after the customer's consent. 5. The customer may nevertheless decline further service from the trader, in which case they pay the inspection costs as stated in article 15 of the general terms. The trader will then make the product available to the customer again, if possible in the condition in which it was received. 6. If the repair must be carried out by third parties, or if delivery of parts by third parties makes the repair impossible within the stated time, the customer will be informed of this and cannot hold the trader to the stated repair time. The preceding article applies accordingly.

Quality

7. Unless otherwise agreed, OEM (original equipment manufacturer) parts are used for the repair, or, if such parts are not available, parts meeting the same quality standards are used. If the customer requests this in advance, the trader will make the replaced parts available to the customer. 8. If, at the customer's request and in consultation with the trader, parts provided by the customer are used, the trader is not responsible for any defects in the installed part or for other shortcomings in the product. In no event can a warranty claim be made as described in consumer legislation. 9. A repair will be carried out in such a way that the device fully complies again with the statutory safety requirements afterwards. 10. After the repair, the customer receives a repair receipt with a brief description of the work carried out and the parts replaced.

Liability

11. The trader is liable for loss and theft of the product, its accessories and attachments, as well as for damage thereto, arising from the time of drop-off until the moment the customer collects the product again. If irreparable damage to the product occurs during this period, the trader is responsible for providing a replacement product. The replacement product will then have at least the same value as the product received by the trader at the time of the repair, taking into account the market value, age and any user damage of the product received. If this is not available, the trader will propose an equivalent alternative to the customer. This excludes products with clear signs of water damage. We wish to remind our customers that iFixers can never be held liable for loss of data. Always try to make a backup in another location (cloud, computer, etc.).

Warranty

12. After completing the repair, the trader gives a 12-month warranty on the repair and/or the replaced part. Batteries are excepted, for which a 6-month warranty applies. This warranty period starts at the moment the product is handed over to the customer. No warranty is given on cleaning or maintenance services, broken glass and user damage, nor on repairs carried out on products with lightning, water or moisture damage, unless expressly stated otherwise on the repair receipt. If the device is opened after the repair by the customer or by third parties, the right to warranty from the trader also lapses. 13. If, within 12 months of handing over the repaired product, the complaints mentioned in article 1 recur, the trader will repair the product again under warranty. a. If the cause of the complaint is the same, only the parts that were not replaced during the previous repair will be charged. b. If it turns out that the cause of the complaint is different from that of the previous repair, the difference in cost of the new repair as referred to in article 2 will be charged to the customer. c. The foregoing provision of this article does not apply insofar as the customer is entitled to dissolution of the agreement in the event of a serious shortcoming in an earlier repair. d. After a renewed repair, the warranty starts again. If, after receiving the repaired product, the customer notices during use an irregularity not mentioned in article 1, they must report this in the shop within 14 days of collection. If this is not possible, they can report the problem by email (info@ifixers.be) and visit our shop at a later time, within 6 weeks of reporting the problem, unless exceptionally agreed otherwise in consultation with the trader. The trader will then investigate whether this is a problem resulting from the repair or a consequence of the complaints mentioned in article 1. In the latter case, this problem can be resolved as described in article 12. Obligation to collect the product. 14. All products entrusted by the customer to the trader must be collected by the customer within a period of 90 calendar days after notification (by phone or email). It is up to the customer to collect the product within this period. If the product is not collected, it will be assumed that the product has been abandoned and ownership will transfer to the trader, who will destroy the material.

No Cure, No Pay

15. If a device still shows the complaints described on the drop-off receipt after repair, or if it is determined upon inspection that the product cannot be repaired, no costs will be charged to the customer. Exceptions: a. In the case of water damage, a fixed inspection fee of €35.00 will always be charged. b. If the trader accepts a product for the repair of a wifi chip (greyed-out wifi), a refund of 100% can be provided within the first three months after the repair date. After the first three months, the trader can provide a refund of a maximum of 50% of the repair cost. If a refund applies, the trader will transfer the amount to the customer's bank account.

Confidential data

16. The trader needs full access to the product for every repair, and will therefore ask for the access code or password of the product if necessary. This is to guarantee the full functionality of the device after the repair as well. Data on the device may unavoidably be viewed in some cases, but will never be stored or misused. Everyone employed by the trader has signed a strict confidentiality clause in this regard, guaranteeing absolute discretion and the utmost respect for the customer's privacy.

Part B — Purchases in the webshop

B1. Application

This part applies to every order placed via www.ifixers.be. By placing an order you accept these terms.

B2. Offer and prices

All prices are in euros and include VAT, unless a product is sold under the margin scheme, in which case VAT is not stated separately. Any shipping costs are shown before checkout. Obvious mistakes or printing errors in the offer do not bind us. Product photos are for illustration purposes; for refurbished devices, the cosmetic condition may vary slightly per device within the chosen quality grade.

B3. Order and payment

The agreement is concluded as soon as you have paid for the order and receive a confirmation by email. Online payments are processed securely via our payment partner Stripe. If a product turns out not to be available after all, we will inform you and fully refund the amount paid.

B4. Delivery and collection

We currently deliver in Belgium, the Netherlands and Luxembourg, to the address you provide when ordering, or you can collect your order from our shop in Leuven. The stated delivery times are indicative; exceeding them does not give a right to compensation, but in the event of a significant delay you may cancel the order free of charge. Risk transfers to you at the moment you receive the product.

B5. Right of withdrawal (14 days)

As a consumer you may withdraw from your purchase without giving a reason within 14 calendar days of receiving the product. Report this by email to info@ifixers.be or in our shop. You must then return or bring back the product within 14 days, complete and in its original packaging. The costs of returning the product are for your account. We will refund the purchase amount, including the standard shipping costs, within 14 days of receiving the withdrawal; we may wait until we have received the product back. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product. The right of withdrawal does not apply to products personalised at your request, and not to sealed products whose seal has been broken after delivery and which cannot be returned for hygiene reasons. The right of withdrawal does not apply to purchases made in our shop and not to business customers.

B6. Warranty

New products carry the statutory warranty of 2 years from delivery. iFixers gives a 2-year warranty on refurbished devices. The warranty covers defects that already existed at delivery, not damage from a fall, water or moisture damage, broken glass, normal wear, or the device having been opened or repaired by third parties. For warranty matters, simply visit our shop in Leuven or contact us via info@ifixers.be.

B7. Gift vouchers

Gift vouchers are valid until the expiry date stated on the voucher and cannot be exchanged for cash.

B8. Complaints and disputes

Complaints can be reported via info@ifixers.be. If we are unable to reach a solution together, you can contact the Consumer Ombudsman Service (www.consumentenombudsdienst.be). Belgian law applies; in the event of a dispute, the courts of the judicial district of Leuven have jurisdiction, without prejudice to the mandatory rights of consumers.
